The study establishes that traditional, human-centric notions of authorship are increasingly strained by AI’s generative capabilities. Philosophically, while AI systems lack true moral agency (consciousness, intentionality, free will), their “functional agency”—the capacity to autonomously produce outcomes—necessitates a re-evaluation of responsibility. The research clarifies that moral agency remains firmly with human users, but AI tools and their developers/platforms bear “functional” and “design responsibility” due to inherent biases, design choices, and deployment mechanisms.
A comparative legal analysis reveals that all three jurisdictions (EU, US, Japan) largely maintain a human authorship requirement for copyright. However, significant divergences exist in their regulatory approaches, particularly concerning the use of copyrighted material for AI training (e.g., Japan’s permissive Article 30-4 vs. the US’s litigated “fair use” and the EU’s TDM exceptions) and the development of AI liability frameworks (e.g., the EU’s proactive AI Act and proposed liability directives vs. the US’s reliance on adapting existing tort law). These differences underscore varying philosophical priorities regarding innovation, human rights, and the balance between public and private interests.
